Rink Rat Rentals - Terms and Conditions

These Terms and Conditions (“Terms”) govern the rental of sports equipment (“Equipment”) from Rink Rat Rentals, LLC (“Rink Rat Rentals,” “Company,” “we,” or “us”). By placing an order through our website, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree, do not proceed with your order.

1. Rental Agreement

By placing an order, you enter into a binding rental agreement with Rink Rat Rentals. The Equipment remains the sole property of Rink Rat Rentals at all times.

2. Rental Period

The rental period is a fixed period selected by the customer at checkout. The rental period begins on the selected start date and ends on the selected end date, regardless of actual delivery or return transit times.

Rental periods are billed monthly unless otherwise specified. Extensions may be available upon request and are subject to availability and additional fees.

3. Delivery

Rink Rat Rentals will use commercially reasonable efforts to ship the Equipment so that delivery occurs on or before the selected rental start date. Shipment of the Equipment on or before the rental start date constitutes fulfillment of Rink Rat Rentals’ delivery obligation. Delivery dates are not guaranteed and are subject to carrier delays outside of Rink Rat Rentals’ control.

4. Equipment Selection, Fit & Use

You are solely responsible for selecting, verifying, and ensuring the proper fit, sizing, and adjustment of all Equipment prior to use. Rink Rat Rentals does not provide medical, safety, or professional fitting advice and does not guarantee proper fit or suitability for any individual user.

Equipment provided may differ in brand, model, color, or cosmetic condition from images displayed on the website or promotional materials.

5. Care of Equipment

You agree to use the Equipment only for its intended purpose and in a careful and proper manner. You may not modify, alter, or repair the Equipment without prior written consent from Rink Rat Rentals.

You are responsible for any damage beyond normal wear and tear.

6. Assumption of Risk; Safety Disclaimer

You acknowledge that participation in hockey and other athletic activities involves inherent risks, including but not limited to serious bodily injury, concussion, paralysis, or death. You voluntarily assume all such risks, whether known or unknown.

No equipment, including helmets or protective gear, can prevent all injuries. Rink Rat Rentals makes no guarantees regarding safety, injury prevention, or concussion prevention. All Equipment is provided “as is” for recreational use only.

7. Release of Liability; Indemnification

To the fullest extent permitted by law, you release and hold harmless Rink Rat Rentals, its owners, officers, employees, and agents from any and all claims, demands, damages, or liabilities arising out of or related to the use, misuse, possession, or condition of the Equipment, including claims arising from ordinary negligence.

You agree to indemnify and hold harmless Rink Rat Rentals from any claims, losses, damages, costs, or expenses (including attorneys’ fees) arising from your use, misuse, modification, or failure to properly use or maintain the Equipment.

8. Authorized Users; Minors

If the Equipment is used by a minor, you represent and warrant that you are the parent or legal guardian of the minor, or otherwise have legal authority to act on the minor’s behalf, and you agree to these Terms for yourself and on behalf of the minor.

9. Returns, Late Fees & Replacement Charges

The Equipment must be dropped off with the designated shipping carrier on or before the rental period end date.

If the Equipment is not dropped off with the shipping carrier within ten (10) calendar days following the rental period end date, replacement charges will be assessed in accordance with the fees listed on Rink Rat Rentals’ Shipping, Exchanges, and Fees Policy page.

Late fees may apply as disclosed on the Shipping, Exchanges, and Fees Policy page.

10. Loss or Damage

You agree to promptly notify Rink Rat Rentals of any loss or damage to the Equipment. You are responsible for repair or replacement costs for lost or damaged Equipment beyond normal wear and tear, as disclosed in the Shipping, Exchanges, and Fees Policy.

11. Payment Authorization

You authorize Rink Rat Rentals to charge the payment method on file for all applicable fees, including but not limited to late fees, repair costs, and replacement charges, as disclosed in these Terms and on the Shipping, Exchanges, and Fees Policy page.

12. Termination

Rink Rat Rentals reserves the right to terminate the rental agreement and reclaim the Equipment in the event of non-payment, misuse of the Equipment, or material violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to conflict-of-law principles.
